The Court of Justice of the European Union (CJEU) has ruled that by taxing winnings from gambling in other Member States while exempting them in its own territory, Italian legislation restricts the freedom to provide services.
In reaching its decision, the court found in favour of Pier Paolo Fabretti, a poker professional sponsored by PokerStars, and Christiano Blanco, who were accused by Italian authorities of failing to adequately declare their winnings from abroad.
