Chad Elie and John Campos were told yesterday by US District Judge Lewis Kaplan that their case was likely to go to trial in March after he heard their motion to dismiss the case brought against them by the US government.

On the eve of the hearing Kaplan accepted the former US solicitor general Paul Clement, one of the superstars of American law, as Elie’s lawyer. Clement forced the judge to consider his arguments for dismissal but they may prove to be futile.
