The state of New Hampshire has filed a complaint challenging the US Department of Justice (DOJ) Opinion that the 1961 Wire Act applies to lottery sales over the Internet.

The filing of the complaint in the US District Court for New Hampshire was announced by Governor Chris Sununu, Attorney General Gordon MacDonald, and New Hampshire Lottery Executive Director Charlie McIntyre.

The complaint seeks declaratory and injunctive relief against the defendant, William Barr, in his official capacity as the Attorney General of the United States Department of Justice (“USDOJ”), and the USDOJ under the Declaratory Judgment Act, and for violations of the Administrative Procedure Act.
