The Netherlands Trade and Industry Appeals Tribunal (CBb) has overturned fines of more than €1m previously handed down to charitable lottery operators for breaching advertising guidelines, deciding that there was insufficient evidence to justify the fines.
The fines were imposed by the Authority for Consumers and Markets (ACM) which found the charitable lotteries BankGiro Loterij, Nationale Postcode Loterij, VriendenLoterij, and their umbrella organization Nationale Goede Doelen Loterijen, guilty of unsolicited telemarketing.
