The Washington Supreme Court ruled unanimously Thursday that the state ban on online gambling which makes the activity a Class C Felony is legal and does not violate the U.S. Constitution.

Justice Richard B. Sanders said the question before the court was not whether internet gambling, including playing poker online, should be illegal. That determination, he said, is reserved to the legislature.

“It is not the role of the judiciary to second-guess the wisdom of the legislature, which enacted this ban. The court has no authority to conduct its own balancing of the pros and cons stemming from banning, regulating, or openly permitting Internet gambling,” wrote Justice Sanders on behalf of the court.
