The US Department of Justice has gone into battle against iGaming but lawyers say its opinion is misguided and politically motivated.
The disconcerting news of the Department of Justice’s re-interpretation of the Wire Act came completely out of the blue last Tuesday morning.
The opinion overturned the DoJ's 2011 opinion, which stated that the Wire Act only applies to sports betting and not other gaming activities. If the 2011 opinion gave states such as New Jersey the confidence to steam ahead with iGaming legislation, there is half a fear that this opinion will do the opposite.
However, a lot has happened since 2011 - states regulating, courts adjudicating - and one suspects that it is too late to turn back the clock. But, this is the DoJ. One must pay them respect - even if this announcement clearly suggests that Sheldon Adelson has been throwing his influential weight around.
