DiCristina ruling: Predominance of skill in poker irrelevant

The US Court of Appeals has reversed a decision of a lower court by ruling that poker does fall within the scope of the Illegal Gambling Business Act, whether or not the game itself is defined as a game of skill.

The initial case involved Lawrence DiCristina, along with co-defendant Stefano Lombardo and others, who operated a poker club in the back room of a warehouse in Staten Island, New York.
